How Do Florida Trial County Courts Work?
Florida County Courts are also referred to as the people’s courts. Florida has at least one county court in all the 67 counties in the state. These courts have original jurisdiction over minor criminal and civil cases. These include a wide range of cases such as civil disputes, traffic offenses, disputes involving $30,000 or less, and other minor criminal offenses (misdemeanors).
Most non-jury trials take place before one judge who serves as the county court judge. There is no fixed number of judges in Florida county courts as the number is directly affected by the county’s population and caseload. To qualify for a county judge’s office, an individual must be an elector of the county. The candidate must also have been a member of the Florida State Bar for a minimum of five years. However, for counties with a population of 40,000 or less, the candidate only needs to belong to the Florida Bar.
County judges in Florida serve six-year terms and are subject to the same disciplinary measures and the jurisdiction of the Judicial Qualifications Commission.
County court case records are maintained at the court’s office clerk in the court where the case was heard. Interested persons may query this office in writing or complete a request form provided by the court. The case number and other details relating to the case may be required during the request process. Generally, some counties such as Broward and Lee maintain a case search portal where case records may be accessed online.
The length of time a case takes in the county court is not fixed, as each case is treated discreetly. The length of time is determined by the facts of the case and the caseload of the court.
