Stat. §§ 943.059 and 943.0585. Interested persons can apply for a Certificate of Eligibility through the following steps:

  • Use the FDLE's Certificate of Eligibility application form or email the FDLE Expunge Section at SEinfo@fdle.state.fl.us to request and receive a copy of the application form by mail or email. Note that the applicant must sign the application in the presence of a public notary or a deputy clerk of the court.
  • Applicants must obtain a certified disposition of the case(s) or criminal charge(s) listed on their completed FDLE's Certificate of Eligibility application form. This may be obtained through the clerk of court in the county where the case/charge(s) originated. If they were placed on probation, they must also provide documents to show that the probation has been terminated. An applicant must also provide a copy of the pretrial completion certificate or a letter of successful completion as a substitution for a certified disposition for pre-trial intervention cases and other diversion programs.
  • Applicants must be fingerprinted by an authorized member of law enforcement or another criminal justice agency and receive a fingerprint form/card.

The FDLE may take up to 12 weeks to process requests and determine an applicant's eligibility for court-ordered expungement. If the FDLE determines that an applicant is eligible, the agency will issue them a Certificate of Eligibility. After receiving the certificate, an applicant can file a petition and all other request documents, including the Certificate of Eligibility, in a court with jurisdiction over where the arrest occurred, such as the Taylor County Circuit Court. Taylor County Arrest Warrants

An arrest warrant is a court order issued by a judge that directs law enforcement officers to arrest an individual for a criminal offense that they are suspected of committing. Per Fla. Stat. § 901.02, judges may issue an arrest warrant upon examination of a complaint and proof that they receive, if they are satisfied that probable cause exists for an arrest warrant issuance for a crime committed within their jurisdiction. Law enforcement officers, such as lead investigators or detectives, usually file these complaints. Fla. Stat. § 901.02 details other grounds for an arrest warrant issuance.

According to the Florida Rules of Criminal Procedure Rule 3.121, an issued arrest warrant must be in writing and the name of the State of Florida and contain the following information:

  • The nature of the offense
  • The name of the person to be arrested, or if their name is unknown, a designated name or description that can be used to identify the person with reasonable certainty
  • The issuance date and county
  • The issuing judge's physical or electronic signature and their office title
  • The bail amount or other release conditions (if applicable) and the return date.

Do Taylor County Arrest Warrants Expire?
