The Rules of Judicial Administration 2.420 defines Florida court records as court file contents created to document case activity, transcripts, documentary exhibits, and electronic records, videotapes, or stenographic tapes of depositions or other proceedings filed with the clerk. These records are in the custody of the Martin County Clerk of the Circuit Court & Comptroller. Court records are accesible online and in perosn at the courthouse and they contain information such as:

  • Case summary (judge’s name, case number, clerk file date, total fees due, agency report number, court type, uniform case number, status date, custody location, case type, status, and agency)
  • Parties (type and party name)
  • Charges (count, description, level, degree, plea, disposition, and disposition date)
  • Events (date, event, judge, location, and result)
  • Case dockets (DIN, image, date, and entry)

Martin County Superior Court Case Search

Martin County Courts structure include the Fourth District Court of Appeal, Nineteenth Circuit and Trial Courts. It does not include a Superior Court which makes it impossible to conduct a Suprioer Court case search. However, all Martin County court records can be obtained online, by mail, email, or in person at the Clerk of the Circuit Court & Comptroller’s Office.

Martin County District Court Records

The Fourth District Court of Appeal hears civil and criminal appeals from the Nineteenth Judicial Circuit. The clerk's Office is the custodian of all court records filed with the court. Interest persons can find District Court records via the following methods:

  • Online: Requests can be made through the Florida Appellate Case Information System. The search types are Case SearchParty Search, or Document Search. Select “4th District Court of Appeal” from the Court dropdown to streamline the search.
  • Mail: Complete the Copy Request Form and mail it to the Clerk’s office. Copies of District Court records cost $1 per page, and certified copies cost $2 per document. The mail package should include a check for the appropriate fees and a stamped, self-addressed envelope.
  • Email: Complete the Copy Request Form and submit it by email at 4dcacopyrequests@flcourts.org.
  • In-person: Requests can be made during business hours (Monday through Friday, 8:00 a.m. to 5:00 p.m.). A name or case number is required to process the request. A fee is required for this service, payable in cash.

Get Martin County Civil Court Records

The Clerk of the Circuit Court & Comptroller’s Civil Division is the custodian of all civil records in Martin County. The Division is divided into:

  • The Circuit Civil Division: Handles civil cases over $50,000. The Division also has jurisdiction over malpractice, mortgage and lien foreclosures, auto negligence, contract and indebtedness, eminent domain, and personal injury cases.

Martin County Family Court Records

The Nineteenth Judicial Circuit Family Division hears cases concerning adoptions, dissolutions of marriage, child custody and support, modification proceedings, name changes, paternity, and domestic violence injunction cases. Individuals can find Family Court records online, by phone, fax, email, mail, or in person. Online requests can be made through the Court Records Request web form or the Case Search portal. Check the Family box while completing the form and select Domestic Relations/Family at the Court Types when using the portal. Email, phone, fax, in-person, and mail requesters can submit a Court Records Request Form.

Martin Dissolution of Marriage Records

The Clerk of the Circuit Court & Comptroller is the custodian of dissolution marriage records in Martin County. These records can be copies by completing the Court Records Request Form and submitting it by mail, email, phone, fax, or in person. Dissolution marriage records can also viewed or copied online through:

Martin County Marriage and Divorce Records

Marriage and divorce records are available at the Martin County Clerk of the Circuit Court and Comptroller’s Office. Divorce records can be obtained online through the Court Records Request web form or Case Search portal. Individuals applying through the web form should select Family under the “Select File Type” area. This service costs $2 per year/per name, the copy fee is $1 per page, and the certification fee is $2 per document. However, access to divorce records through the Case Search portal is free.

Martin County marriage records can viewed online through the Official Records portal or at the Clerk’s office for free. Requesters can also call (772) 288-5551 to inquire about marriage certificates recorded prior to January 1, 1999. Interested individuals can also send a written request to the Clerk’s office for a copy of their marriage records. The name of the couple and the marriage date (if known) must be provided to process the request. Copies of the Martin County marriage certificate cost $1 per page and an additional $2 for certification. Payments should be made by check.

Martin Birth and Death Records

Martin County public records exclude birth and death records. For example, Martin County birth records that are less than 125 years old and death records that include the cause of death are confidential for 50 years. However, death records without cause of death information are open to individuals 18 years and above. Confidential birth and death records are only issued to:

  • The subject of the record if they are of legal age (only for Martin Couty birth certificates)
  • parent, spouse, legal guardian
  • A legal representative
  • Someone with a court order
  • Decedent’s child, grandchild, or sibling, if of legal age

Mail requests require submitting a completed Application for Birth or Death Certificate Form with the appropriate fee and a valid ID to the Department. Martin County birth certificates cost $17, and plastic covers cost $5, payable by check or money order. Death certificates cost $15, and search fees cost $10.

The search criteria are name, document, book and page, consideration, record date, or clerk file number. The search parameters are by name, address, and account number. In-person requests can be made at any of the Tax Collector's office locations.
