Levy County Arrest Records Vs. Criminal Records

According to Florida law, there is no timeline for a record custodian to remove an arrest record. In Levy County, arrest records are kept by agency record retention schedules and the state's public records laws. According to Item #32 of the Florida Department of State's General Records Schedule GS-2 for Criminal Justice Agencies and District Medical Examiners, the typical guideline for keeping arrest records in Florida is "until obsolete, superseded, or administrative value is lost".

Depending on the circumstances surrounding an arrest, different expungement and sealing processes apply in Levy County. For example, under Fla. Stat. § 943.0581 and Fla. Admin. Code, R. 11C-7.008, an adult or minor whose unlawful or erroneous arrest may request an administrative expungement from the Florida Department of Law Enforcement.

To get a judge to decide whether to give an order for sealing or expungement, the petitioner may also need to attend the hearing in person and provide copies of the papers to the appropriate State Attorney's Office.
