Brevard County Court Records

Brevard County court records contain information about court cases adjudicated in Brevard County, Florida. Court records are created and maintained from the initiation of a civil or criminal case, from filing to adjudication and appeal. Access to these records is a statutory right for residents of Florida and facilitates transparency and accountability in the Florida judicial system.

A person who obtains Florida court records can expect to find information about the litigants, a description of the case, and documentation of actions taken throughout the case. Relevant documents that make up the court case record include motions, affidavits, summons, orders, and court transcripts.

Are Court Records Public in Brevard County?

Yes. Brevard court records are public records per the Florida Sunshine Law (Fla. Stat.§ 119.011). Per this law, documents generated by public officials in the execution of their duties are public records, including court records (Fla. Stat.§ 119.0714). Hence, interested members of the public may obtain copies of court files associated with civil and criminal cases in Florida.

Despite the aforementioned statutory provisions, documents containing sensitive information that may compromise the safety, privacy, or financial security of an individual or business are exempted from public access. For example, files containing information about confidential informants in criminal cases are not public. For civil cases, case parties may petition the court to redact details or sequester files containing private information from public access (Fla. Stat.§ 119.0714.2a). Similarly, documents containing information about minors are restricted from unauthorized access.

Notwithstanding the exemption above, accessing redacted information or sealed court records is still possible. However, a requestor must petition a court of competent jurisdiction to access sealed court records. For a successful petition, the requestor must demonstrate that the need to access that record outweighs the statutory exemption or basis of the court order restricting access in the first place.

Brevard County Court Records Search

Persons who wish to find Brevard County court records have three options.

  • Online search on databases
  • In-person search at the court location
  • Mail request sent to the custodian.

Generally, court records are available via online repositories maintained by the judiciary. It is also possible to conduct a Brevard County court record search by visiting the record custodian’s office during business hours. There, a searcher may use public access terminals to obtain digital court records or search through physical archives for hard copies of court records.

Inquirers who cannot personally visit the record custodian’s office may send a mail-in request. The letter must describe the record sought and include a valid return address and other requirements to facilitate a return. For example, a mail-in application packet to search for court records usually contains a letter describing the court files, a self-addressed stamped envelope, and a money order for the associated administrative fees.

Brevard County Court Records Search by Name

A name-based search for Brevard County court records typically requires that the searcher knows the name of at least one party. In a criminal case, the defendant’s name is required. For both criminal and civil cases, though, providing the plaintiff’s name, the presiding judge’s name, or the names of the representing attorneys may facilitate record retrieval.

Name-based searches done on the Brevard Electronic Court Application (BECA) repository are free, and searchers typically get access to most court documents filed in the case. However, access to certain documents is by request only, and files containing sensitive information are typically sealed.

Persons who wish to obtain physical copies of case files or get certified court records may contact the Clerk of Court’s Office. However, they will be required to cover the administrative costs of retrieving, copying, and certifying the documents. Details of these fees are provided in the miscellaneous section of the court schedule of fees.
